Payment and Cancellation Policies
North Star Graphics invoices exclusively via e-mail. Under no circumstances are we able or willing to send hard-copy invoices. All invoices must be paid, in full, within 15 days from the date the e-mail was sent. Unpaid invoices may result in temporary suspension of your account. A re-activation fee of $25 will be charged on any account that is temporarily suspended for non-payment, to cover the cost of re-activating the account. There is a $25 fee for any check returned to us for non-sufficient funds or stopped payment.

For accounts wishing to pay via credit card, we require a credit card authorization form to be placed on file with North Star Graphics. This form will be sent within 10 days of account activation. The form is sent in Adobe PDF format, via e-mail. We would be happy to fax a copy of the form at your request.

The credit card authorization form must contain the signature of the credit card holder. Accounts paying by credit card will not receive monthly invoices. We will automatically debit your credit card for the proper amount each billing cycle. A receipt for the charge is automatically generated, via e-mail, each time your card is charged. A receipt will only be received if the e-mail address indicated on the credit card authorization form is valid.

Account cancellations must contain the signature of the account owner, the domain name for the account being cancelled, and a brief statement that specifically requests that your account be removed from our servers.

When you cancel your account, you will receive a refund equal to any unused portion of your service for which you have pre-paid. You will not receive a refund for time that your account resided on our servers, unless your cancellation is made within the first 14 days of the account sign-up. Setup fees, when applicable, are non-refundable. However, all shopping cart fees, when applicable, are non-refundable. When paying for a shopping cart, you are buying it for a certain allotted time. If you use the cart for the entire pre-paid time or not, North Star Graphics is not responsible for any unused balances.

You are obligated to pay for your account even if you do not use it. Because we have provided you with usernames, passwords, DNS entries, and an IP address, you have the ability to use your account. The fact that you do not do so is not relevant - you are still obligated to pay for the account. Even an unused account uses valuable system resources that could be used for other customers.

If you have a past-due balance on your account at the time the account is closed (either by your request or due to non-payment), the remaining balance must be paid within 30 days of when the account is closed. If we do not receive payment on the remaining balance in that time, we will begin efforts to collect any fees owed. We apply a $20.00 collection fee to cover our costs in attempting to collect your debt. If our internal collection efforts fail, we reserve the right to turn the account over to a 3rd-party (either collections agency or attorney) for further action. We also reserve the right to report your unpaid balance to credit reporting agencies as well as ISP/web host information services.

Domain Names:
All domain names that have been registered with North Star Graphics, will be kept active for as long as you have your account. Once your account has been cancelled we will no longer renew your domain unless specifically set up to do so. Domains are renewed on a yearly basis @ $20.00/year. Credit can not be issued for the remainder of the time your domain is active. It will expire 1 year from the date it was renewed on. Domains can be transferred to a new registrar at your request. However the new registrar may require you to remit payment again.

Content:
All services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening, obscene, demeaning to others, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service which damages the subscriber or any other party.

Note: Pornography and sex-related merchandising are prohibited on all servers. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited.

In addition any site selling or promoting Bulk email services is not allowed

Examples of non-acceptable content or links:

• Pirated software
• Hackers programs or archives
• Warez Sites
• Irc Bots
• Mp3

We will be the sole arbiter as to what constitutes a violation of this provision.

Traffic Guidelines
Due to the unique resource characteristics and traffic patterns associated with certain types of sites, the following are limited to 3 gigs of free traffic:

• Sub hosting - any domain housing additional users
• Shareware, sound, video, image and multimedia archives
• Mirror sites
• Distribution points
• Any site whose primary purpose is file distribution

CGI Scripts
Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation without prior warning.

Chat Rooms
We do not allow clients to install their own chat rooms. These tend to be large system hogs and we cannot allow it as an account option. We do provide a choice of Java chat rooms for a small extra charge that will more than fill your needs and run without hindering the performance of the machine for others.

Background Running Programs
We may allow programs to run continually in the background. These are considered on a one to one basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Commercial Advertising - Email
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. In addition, we will impose a $200 penalty for each spam policy violation. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy.

As such, any violation will result in immediate deactivation of services without refund.

Server Abuse:
Any attempts to undermine or cause harm to a server is strictly prohibited.

Indemnification
Customer agrees that it shall defend, indemnify, save and hold North Star Graphics harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against North Star Graphics, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless North Star Graphics against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with North Star Graphics server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement.

Confidentiality Statement
We at North Star Graphics insure that all personal information submitted to us in processing your order and for billing purposes, etc., including but not limited credit card information, will be kept strictly confidential and used solely by North Star Graphics, its representatives and employees, for the purposes for which it was intended, for the benefit of the subscriber. We agree not to share or release such information to any individual, entity, or third party, without the consent of the subscriber, except as required by law, regulation or governmental authority. All information provided to us by the subscriber is properly stored and handled at all times by authorized North Star Graphics staff members only.

Refusal of Service
We reserve the right to refuse or cancel service at our sole discretion.

Disclaimer
North Star Graphics will not be responsible for any damages your business may suffer. North Star Graphics makes no warranties of any kind, expressed or implied for services we provide. North Star Graphics disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, and any and all service interruptions caused by North Star Graphics and its employees. North Star Graphics reserves the right to change or update policies without notice.

Privacy Policy
North Star Graphics insures that all personal information being voluntarily submitted to us in the processing of your order (to be used for record and billing purposes, etc.), inclusive, but not limited to, credit card and other personal information, will be kept strictly confidential and used "solely" by North Star Graphics, its authorized representatives and employees; for the strict purpose for which it was intended, and for the benefit of the Subscriber. We agree not to share, rent, sell or release this information to any individual, entity or third party, for any reason, without the specific written consent of the Subscriber; with exception as required by Law, Regulation or Governmental Authority.

North Star Graphics is committed to protecting and securing all Subscriber provided information, through the use of firewalls and additional security measures in place at its physical facilities to protect against the loss, misuse or alteration of such information.

If any terms or conditions are failed to be followed it will result in grounds for immediate account deactivation.
